FOR FREIGHT FORWARDER ACTIVITIES
Freight Forwarder figure is under regulations in Spain since 1987.
LOTT
Act (Act regulating Carriage by Road) provides in
section 126 that the
Freight Forwarder is one of the figures, apart from Transport Agencies and Warehousemen/Distributors
which are classified as auxiliary and complementary activities of transport.
LOTT Act has been developed in law by its Regulations (ROTT). Subsequent
Ministerial Orders have regulated several requirements which must be satisfied
by any activity auxiliary or complementary to the transport (ROTT sections 167
to 170).
- Brief description of the requirements that may be satisfied under rules
in force by Freight Forwarders:
Every Freight Forwarder must have an authorisation issued by Transport
Administration which must be reviewed every even year: this authorisation
is granted after having proved that the following requirements are performed:
- Vocational Qualification: The holder or the attorney of the company
must have a Vocational Qualification Certificate, have legal powers and
either be in list as manager or hold at least 15 % of the share capital
of the company.
- Financial Standing: The paid up capital plus reserves of the company
must be, at least, 60.000 EUR (9.983.160 PTAs.).
- Honorability.
- Be up-to-date in its tax and Social Security payments
